Terms of service

Last updated: October 2026

These Terms of Service apply to subscriptions and design services provided by Design Shake through designshake.co.uk.

By purchasing a Design Shake subscription, you confirm that you are entering into these terms on behalf of a business, organisation or other professional entity and that you have authority to do so.

1. About Design Shake

Design Shake provides ongoing graphic design support through a monthly subscription.

Business name: Design Shake
Email: hello@designshake.co.uk
Telephone: 01323 335025

2. Business use only

Design Shake is intended for businesses, organisations and professionals purchasing services for business purposes.

If you are purchasing as a consumer rather than for business purposes, please contact Design Shake before subscribing. Nothing in these terms affects any rights that cannot legally be excluded or limited.

3. The subscription

The standard Design Shake subscription currently costs £795 per month.

Your subscription includes:

  • unlimited design requests in your queue;
  • unlimited revisions;
  • one active design request at a time;
  • access for members of your team;
  • ongoing graphic design support within the normal scope of the service;
  • editable or source files where appropriate.

The subscription renews automatically each month until paused or cancelled.

Any applicable taxes or additional charges will be shown where relevant.

4. Unlimited requests

“Unlimited requests” means that you may submit as many design requests as you need and keep multiple requests waiting in your queue.

It does not mean unlimited simultaneous work or guarantee a specific number of completed projects within a billing period.

Design Shake works on one priority request at a time. Once that request is completed or paused, the next priority request can begin.

5. Turnaround times

Design Shake aims to keep work moving quickly, and many everyday requests can be completed or ready for review within a working day.

Turnaround depends on the size, complexity and clarity of each request.

Simple social graphics, minor document updates or straightforward presentation work may move quickly, while larger reports, presentations, campaigns, branding projects and other substantial pieces of work will naturally take longer.

Any turnaround time given is an estimate rather than a guaranteed deadline unless a specific deadline has been agreed separately in writing.

6. Starting your subscription

Your subscription begins once payment has been successfully processed through Stripe.

Design Shake will provide the information you need to begin submitting requests. In most cases, clients can submit their first request on the same day they subscribe.

7. Submitting requests

Design requests are normally managed through Trello or another agreed project-management method.

You are responsible for providing the information, copy, images, brand assets, dimensions, specifications and other materials reasonably required to complete your request.

Incomplete briefs, delayed feedback or missing content may affect turnaround times.

8. Revisions

Revisions are included within your subscription.

There is no fixed limit on reasonable revisions to a request, provided they remain related to the original brief.

If the direction or scope changes substantially, Design Shake may treat the changes as a new request and move them into the queue accordingly.

9. What is included

Design Shake covers a broad range of graphic design work, including digital design, print, presentations, documents, campaigns, branding, social media assets, event materials and related creative work.

Services outside normal graphic design work may require a separate quotation or agreement.

This may include substantial website development, photography, video production, specialist copywriting, animation, printing, media buying or other specialist services.

10. Third-party costs

Your subscription does not include third-party costs unless expressly agreed.

These may include printing, stock photography, premium fonts, licences, paid templates, specialist software, media spend, website hosting, domain names or external production costs.

Any such costs will be discussed with you before they are incurred on your behalf.

11. Payment

Subscription payments are processed through Stripe.

Payment is taken monthly in advance on your recurring billing date.

You are responsible for keeping your payment information up to date.

If payment fails or remains outstanding, Design Shake may pause work until payment has been successfully received.

12. Pausing your subscription

You may request to pause your subscription through Stripe where that option is available, or by emailing Design Shake.

Unless otherwise agreed, a pause takes effect from the end of your current paid billing period.

No refund or credit is normally provided for unused time within a billing period.

Because Design Shake works with a limited number of clients, immediate availability cannot be guaranteed when you choose to restart a paused subscription.

13. Cancelling your subscription

You may cancel your subscription through Stripe or by contacting Design Shake.

Cancellation must be requested at least 7 days before your next billing date if you do not want the next monthly payment to be processed.

Your subscription will remain active until the end of the period you have already paid for unless otherwise agreed.

14. Refunds

Subscription payments reserve design time and capacity for your business and are therefore non-refundable once processed, except where required by law or where Design Shake agrees otherwise in writing.

No partial refunds are provided for unused days, unused requests, changes in workload or early cancellation during a paid billing period.

If you believe a payment has been taken incorrectly, please contact Design Shake and the issue will be reviewed promptly.

15. Client responsibilities

You agree to:

  • provide accurate and sufficiently clear briefs;
  • provide content and feedback within a reasonable timeframe;
  • check and approve final work before publication, printing or distribution;
  • check names, dates, prices, contact details, factual information and other important content;
  • ensure you have permission to use any materials you supply;
  • use the service lawfully and professionally.

Design Shake is not responsible for errors that remain in work you have reviewed and approved, except where Design Shake has acted negligently.

16. Content supplied by you

You retain ownership of the materials you provide to Design Shake.

By providing content, images, logos, fonts, documents or other materials, you confirm that you have the necessary rights or permissions for Design Shake to use them in connection with your requests.

You grant Design Shake permission to use those materials solely as reasonably necessary to provide the service.

17. Ownership of completed design work

Once all amounts due have been paid, Design Shake assigns to you the intellectual property rights owned by Design Shake in the final approved design work created specifically for you.

This does not include:

  • third-party fonts, photographs, illustrations, templates or other licensed assets;
  • software or platform elements owned by third parties;
  • pre-existing Design Shake materials, systems or reusable components;
  • unused concepts, rejected concepts or working files that were not part of the final approved work.

Third-party materials remain subject to their respective licence terms.

18. Source files

Editable or source files may be supplied where appropriate and where the software or licence used allows them to be shared.

Design Shake currently works primarily with Figma, Affinity and Canva.

Design Shake is not responsible for compatibility with software you use after files have been supplied.

19. Portfolio use

Unless confidentiality has been agreed, Design Shake may display completed and publicly released work in its portfolio, website, social media and promotional materials.

If a project is confidential or you do not want it displayed publicly, please let Design Shake know in writing.

Design Shake will not intentionally publish confidential or unreleased information.

20. Confidentiality

Design Shake will take reasonable care to keep non-public information supplied by clients confidential and will use it only where reasonably necessary to provide the service.

This does not apply to information that is already public, independently known, lawfully received from another source or required to be disclosed by law.

21. Third-party platforms

Design Shake uses third-party platforms including Stripe, Trello, Figma, Canva and other software where appropriate.

Design Shake is not responsible for temporary outages, changes, failures or discontinuation of third-party services outside its reasonable control.

22. Availability of the service

Design Shake aims to provide a reliable ongoing service but does not guarantee uninterrupted availability.

There may occasionally be interruptions due to illness, holidays, technical problems, emergencies or circumstances outside reasonable control.

Where reasonably possible, affected clients will be kept informed.

23. Ending or suspending the service

Design Shake may suspend or terminate a subscription where:

  • payments remain outstanding;
  • the service is being misused;
  • a client behaves abusively or unlawfully;
  • requests involve unlawful, harmful or inappropriate material;
  • continued provision of the service is no longer reasonably possible.

Where appropriate, Design Shake will try to provide reasonable notice before ending the service.

24. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence.

To the fullest extent permitted by law, Design Shake will not be liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of opportunity or loss arising from decisions made using design work supplied through the service.

Design Shake’s total liability arising from or connected with the subscription will not exceed the subscription fees paid by you to Design Shake during the six months immediately before the event giving rise to the claim.

25. Events outside our control

Design Shake will not be responsible for delay or failure caused by events outside its reasonable control, including major technical failures, internet outages, natural disasters, serious illness, government action or failure of essential third-party services.

26. Changes to the service or these terms

Design Shake may occasionally update the service, pricing or these Terms of Service.

Material changes that affect existing subscribers will be communicated before they take effect where reasonably appropriate.

Changes to subscription pricing will not normally take effect until a future billing period.

27. Governing law

These terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising in connection with these terms, subject to any rights that cannot lawfully be restricted.

28. Entire agreement

These Terms of Service, together with any written agreement, quotation or specific terms agreed between you and Design Shake, form the agreement relating to your subscription.

If a separately agreed written term conflicts with these general terms, the separately agreed term will take priority for that particular matter.
